Please read the following provisions carefully before accessing the Conciergite website. These terms of use constitute a legal agreement between you and Conciergite, governing your use of the website and the purchase of services offered on the www.conciergite.com website.

By using this site, you agree to be bound by these Terms, including the referenced policies (such as the Privacy Policy). Conciergite reserves the right, at its sole discretion and without notice, to modify or replace these Terms at any time. Your continued use of the Site following the posting of changes will mean that you accept the new Terms in effect. If you do not agree to the updated Terms, you must immediately cease using the Site.

If you do not agree, in whole or in part, with these Terms of Use, you may not use the Website. We invite you to contact Conciergite with any questions or concerns you may have regarding these Terms.

DEFINITIONS

The following terms are used in these Conditions and have the meanings described below:

  • We”, ‘Us’ and ‘Our’ mean Conciergite.
  • “Website” and ‘Site’ refer to the www.conciergite.com website.
  • “Platform”: Refers to the online concierge services booking and payment platform offered by the Website for occasional renters.
  • “Payment Method” means a valid payment method accepted by Conciergite and its third-party partner PayPal, including Visa, MasterCard, and PayPal accounts.
  • “You” and ‘Your’ refer to you, the user of the service or visitor to the Website.
  • “Landlord”: Refers to a natural or legal person who rents or sublets residential space for a short period of time to a tenant, including via online booking platforms such as Airbnb, HomeAway, Flipkey, Housetrip, Kijiji, Lespac, Craigslist, etc.
  • “Tenant”: Refers to a natural or legal person who rents or sublets residential or professional space from a landlord for a short period of time.

1. Service and product

Our website offers a dedicated platform for Renters, enabling them to consult our online concierge services for the spaces they rent for short periods. These services are exclusively reserved for Renters offering short-term rentals.

Services available on the platform include:

  • Ad optimization and dynamic pricing
  • Premium housekeeping worthy of a 5 stars hotel
  • 24/7 assistance for your guests
  • Rigorous inspection at every check-in and check-out
  • Replenishing essentials
  • Exterior maintenance, including winter snow removal
  • Professional photography

Areas served :
Conciergite services are currently available in the following regions: Montreal, Brossard, Longueuil, Mont-Tremblant, Trois-Rivières, Granby, Quebec City and Sherbrooke.

Modifications to services:
Conciergite reserves the right to modify at any time the services and products offered on the website and the platform in order to better meet your needs.

2. Important details

The Landlord must provide the Tenant’s contact information to the assigned concierge at least forty-eight hours (48h) prior to the Tenant’s arrival. This will enable the concierge to validate the arrival and make the necessary arrangements with the Tenant.

Conciergite reserves the right to charge additional services to the Tenant under certain conditions, such as for additional decorations or unreasonable laundry or for a change in the Tenant’s arrival or departure date.

3. Prohibited use

Use of the Website and Platform is strictly limited to the purposes permitted by these Terms or described on this Site. Any non-conforming use is strictly prohibited. In particular, you may not:

  • Copy, publish, modify, create derivative works from, transfer, sell or distribute any content or product of Conciergite without prior written permission.
  • Use robots, spiders, scrapers or any other automated tool to access the Website or Platform.
  • Copy, pirate or exploit the database, the Website, the Platform or any associated content.
  • Use the Website in a manner that violates applicable local, national or international laws or regulations.
  • Access the Website for illegal, fraudulent or malicious purposes.
  • Use the Website to transmit or receive unsolicited advertising (spam) or any unauthorized promotional material.
  • Intentionally send or upload files containing false information, viruses, malware or any other code designed to damage or disrupt the operation of the Website, the Platform or its servers.
  • Delete or modify copyrights, trademarks or other intellectual property notices displayed on the Website or Platform.

Any breach of these rules may result in legal action and/or immediate suspension of access to the Platform and Services.

4. Specific obligations of users

  • Transmit unsolicited e-mails, chain letters or spam via the Site;

User responsibility
Users are entirely responsible for actions and communications made via the Site on their behalf. They agree to comply with all applicable laws in connection with their use of the Site.

Right of refusal
Conciergite reserves the right, at its sole discretion, to refuse access to certain users or customers, and to cancel any order if necessary.

5. Social media

The following conditions apply when you access a page, account, site, network or application managed by Conciergite on social media.

By using these platforms and submitting a comment, photo, video or other content, you (and your parent/legal guardian if you are under the age of majority in your province or territory of residence) agree to abide by these Terms, the Conciergite Privacy Policy and the terms of use of third-party social media providers.


Terms of use for social media

Some comments or content posted on social media pages do not represent the opinions or policies of Conciergite. You agree not to post or submit content that falls into any of the following categories:

  • Defamatory, abusive, counterfeit, obscene, misleading or illegal content;
  • Content that infringes on the rights of others, including those related to the protection of personal information;
  • Advertising, promotional material or unwanted solicitations ;
  • Falsified content or content containing personal or financial information about you or another person;
  • Any publication deemed to be in violation of the Site’s Terms of Use.

Any content belonging to these categories will be deleted immediately without notice or liability to Conciergite.

Conciergite does not actively filter posts on its social media pages and accepts no responsibility for messages posted by users. The information shared remains the responsibility of its authors.

6. Intellectual property

The Website, the Conciergite Platform, their content and all associated intellectual property are the exclusive property of Conciergite, its affiliates or third parties. All right, title and interest in and to the Website and Platform remain with us or such third parties. The names Conciergite and other marks related to our products and services on the Site are our exclusive marks or those of their respective owners.

All content and information published on the Website are protected by applicable laws, including those relating to copyrights and trademarks in Canada and internationally. Unless expressly authorized in writing by Conciergite, such content may not be copied, modified, published, reproduced, distributed, sold or used for commercial or public purposes.

Permitted use:
You may view, download or print the contents of the Website solely for personal, non-commercial use, provided:

  • Retain all copyright and trademark notices;
  • Not to modify the texts or images;

  • Loss of profits, data, operations or reputation;
  • Theft or damage to the premises.

These exclusions apply whether the claim is made in contract, tort or otherwise. However, some federal or provincial laws may limit or exclude these exclusions, in which case they may not apply to you.

Your contractual relationship is strictly with Conciergite. No affiliate or agent of Conciergite assumes any responsibility to you in the performance of the agreed tasks.

Indemnification
You agree to indemnify and hold harmless Conciergite, its affiliates, officers, employees and agents, from and against any and all losses, claims, actions or expenses (including reasonable legal fees) arising out of:

  • Your use or misuse of the Site or Platform;
  • Any activity carried out under your account associated with your email address;
  • Your violation of these Terms or the rights of any third party.

Time limit for recourse
Any claim or cause of action relating to services must be brought within one (1) year of the event in question.

8. Judicial district and jurisdiction

This agreement shall be governed by, construed and enforced in accordance with the laws of the Province of Quebec, Canada, without regard to principles of conflict of laws. If you fail to comply with these Terms, our failure to act immediately shall not constitute a waiver of our rights, including the right to seek remedies at a later date.

If any provision of these Terms is held to be unenforceable, the remaining provisions shall remain in full force and effect. Terms which by their nature are intended to survive the termination or expiration of these Terms will survive the cancellation of your registration or the expiration of this agreement.
